A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, APRIL 9, 2024. Present were: Mayor Adams, Trustee Seibert, Trustee Cardali, Trustee Bencivenga, Trustee Miga and Village Attorney Charles J. Casolaro. On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, the work session opened at 7:02 PM. On the motion of Trustee Bencivenga seconded by Trustee Seibert and unanimously carried, the work session ended at 7:53 PM.

Regular meeting of the Board of Trustees opened at 8:01 PM.

The Pledge of Allegiance was led by Trustee Seibert.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

RESOLVED to approve the minutes of the March 26, 2024 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the letter from the General Convention of the Babylon Fire Department dated April 4, 2024:

The annual meeting of the General Convention of the Babylon Fire Department was held at 8:00 PM on Thursday, April 4, 2024 as prescribed by Article III, Section 1 of the Department Bylaws.

The purpose of the Convention was to elect nominees for the office of Chief Engineer, First Assistant Chief, Second Assistant Chief and Third Assistant Chief.

The nominees receiving the plurality of votes were as follows:

     Chief Engineer                         James P. Miga

     First Assistant Chief                William T. Sadousky

     Second Assistant Chief         Eric P. Price

     Third Assistant Chief              Tony C, Schultz

** The Village Clerk read the letter from the Fire Department to the Board listing individuals elected to serve their Companies, Squads, or Units as Officers or Wardens **

RESOLVED to accept the Fire Department actions as read.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

RESOLVED to schedule a public hearing to be held on Tuesday, April 23, 2024 at 7:00 PM to consider the adoption of proposed Local Law 0423PH-Tax of 2024 regarding Fees. Complete text of the above Local Law will be available beginning April 11th, 2024 in the Office of the Village Clerk and on the Village website, www.villageofbabylonny.gov.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

RESOLVED to grant permission to the Babylon Breast Cancer Coalition to maintain temporary 8 ½ x 11” signs at various merchants in the Village from April 8th to May 15th, 2024 to advertise the Chefs for a Cause fundraiser to be held May 15th at The Piermont.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

RESOLVED to issue a refund in the amount of $25 to Raymond Voulo for overpayment of a Crabbing Permit.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried,

WHEREAS, a Public Hearing was held on Tuesday, March 26th, 2024,

BE IT HEREBY RESOLVED to approve the application of Roberto L. Nicolia, Roman Development LLC, 612 Muncy Avenue, Lindenhurst, to open a new restaurant,

And, be it further

RESOLVED to approve and adopt the attached covenants and restrictions for the proposed Seafood Market, 32-36 Deer Park Avenue. [Section 010/ Block 03/ Lot 048]

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to issue a refund in the amount of $25 to Andrew Cathcart for overpayment of his 2024 boat slip renewal for Slip # 67 on Lewis Pond.

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to issue a refund to Cindy Gerdjikian for overpayment of $35 for renewal of East Creek boat slip #40102.

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to issue a refund in the amount of $25 to Randy DeVoe for overpayment of renewal of Boat Slip #17 at Lewis Pond.

    On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to grant permission to Babylon American Legion Post #94 to hold their annual Memorial Day Parade on May 27, 2024. The parade will start at 10:00 AM at Foster Blvd. and Deer Park Ave. The parade will proceed south on Deer Park Ave. to Montauk Hwy., then west to the Argyle Park Bandshell, where the ceremonies will be held. Upon conclusion of ceremonies, refreshments will be served at Babylon Post #94, located at 22 Grove Place. This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured and a signed and notarized hold harmless agreement.

    On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to hold the Annual Car Show at the Gilbert C. Hanse Village Pool parking lot on Sunday June 9th from 10am – 3pm.

    On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED for the Village of Babylon to hold an Annual 9/11 Memorial March to be held on Wednesday September 11, 2024 at 8:30 AM.

    On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to approve the following warrant for April 9, 2024:

                   GENERAL ACCOUNT:           $ 508,101.43

                        CONKLIN HOUSE:            $     1,127.18

               TOTAL GENERAL FUND:           $ 509,228.61

                               TRUST FUND:            $ 17,000.00

                                          TOTAL:            $ 526,228.61

    On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to accept the resignation of Marisa Vanasco, full time laborer, effective March 29, 2024.

    On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED that the Board of Trustees will hold a public hearing at 7:00 PM on Tuesday, April 23rd, 2024, to consider the application of My Play Space LLC to open a children’s party/play place at 103-105 West Main Street, the former location Unique Golf. Copy of application and plans will be available beginning April 16, 2024, in the Office of the Village Clerk.

    On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to accept the resignation of Mike Ruiz, Parking Meter Officer, effective April 5, 2024.

    The following announcements were made:

         ·Trustee Seibert noted that the Village is still taking employment applications for summer recreation programs. 

        · Trustee Bemcivenga stated that they are aerating at the Golf Corse next week and the course is looking good.   Dock News; we are starting to reach out to our boat subletters.

         · Trustee Cardali reminded all the first day to register for pool passes and lessons is May 11th. Registration for pool passes and swim lessons will be the Village Hall from 9:00 AM – 12:00 PM. Shred Day is Saturday, April 20th, from 9:00 AM – 12 noon at the Village Highway Department.

         · Trustee Miga confirmed the Community Bike Ride on Saturday, May 18th at 10:00 AM, route to be determined, but will be south of Montauk Highway.   Coming in Spring, Bethpage Bike rentals will be available.

    The meeting was opened to the public; no one addressed the board.

    On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, the meeting adjourned at 8:35 PM.
