A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, DECEMBER 13, 2022. On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, the meeting opened at 7:18 PM. On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, the board entered into executive session at 7:32 PM to discuss current litigation and human resource issues, at which time the work session was ended. On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, the executive session ended at 8:02 PM.

Regular meeting of the Board of Trustees opened at 8:06 PM.
The Pledge of Allegiance was led by Trustee Bencivenga.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to approve the minutes of the November 22, 2022 regular meeting of the Board of Trustees as amended and dispense with the reading of the same.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to hire Richard Johnson as a full time laborer with an annual salary of $35,360 effective October 19, 2022.
On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was
RESOLVED to hire Corey Smith as a part time laborer with an hourly salary of $10.50 effective November 7, 2022.
On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to accept the resignation of David Ambrose, full time laborer, effective December 9, 2022.
On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to accept the resignation of Giovanni D’Angelo, full time laborer, effective December 20, 2022.
On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

to terminate Maldane Cockett, full time laborer, effective November 30, 2022.
On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to terminate Hashem Poindexter, part time laborer, effective November 25, 2022.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED
to grant permission to the Ancient Order of Hibernians St. Patrick’s Division 2 to hold the annual Saint Patrick’s Day Parade on Sunday, *March 26th*
at 2 PM. This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured and a notarized hold harmless agreement. *amended to March 19th, 2023*
On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to grant permission to the Babylon Beautification Society to hold the 2023 Annual Fair on September 10th (rain date September 17th) including permission to sell beverages (beer, wine, water) on the north side of Argyle Lake. This permission is granted only for the 2023 Annual Fair and is contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured and a signed and notarized hold harmless agreement.
On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to grant permission to Babylon Little League to hold the annual Opening Day Parade at 10:00 AM on Saturday, April 15, 2023. The Parade will start at the Fire House parking lot, head south on North Carll Avenue to Main Street; East on Main Street to Deer Park Avenue; north on Deer Park Avenue to Railroad Avenue; west on Railroad Avenue to North Carll Avenue; north on North Carll Avenue to Locust Avenue; west on Locust Avenue to the Locust South field, where the ceremony will start at approximately 11:00 AM. (Sound equipment will be set up in the infield of the Locust South field.) This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed and notarized hold harmless agreement.
On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to grant permission to Dominic Pepito, of Universal Paranormal to hold Historical Walking Tours by the locations on the attached list on Tuesdays & Thursdays from 7:00 PM- 8:30 PM on the following dates: January 10th, 12th, 17th, 19th, 24th, 26th and 31st, 2023
On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was
RESOLVED to deny permission to the Long Island Youth Club to canvass/fundraise in the Village from 11:00 a.m. to Sundown on the following weekend:
Saturday, December 17th, 2022 and Sunday, December 18th , 2022
On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was
RESOLVED to grant permission to St Nicholas Greek Orthodox Church to use Argyle Park at 12:00 Noon on Sunday, January 8, 2023, for the annual Blessing of the Waters. This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured and a signed and notarized hold harmless agreement.
On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to grant the application of Thomas DelFranceso of T.D. Vending Corporation to operate a Mister Softee Ice Cream Truck in the Village of Babylon for the 2023 season. This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured, and a signed and notarized hold harmless agreement.
On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was
RESOLVED to accept the attached contract renewal with Babylon Village Internet Service for the period January 1, 2023 to December 31, 2023.
On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED
that the Board of Trustees approves the East West Beach Fire Protection District Contracts, approved as to form by the Village attorney, and authorizes the Mayor to execute the same.
On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to approve the following warrant for December 13, 2022:

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law 1213PH §343-9 of 2022 amending Chapter §343-9 Speed Limits, and therefore,
BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment.
WHEREAS a Public Hearing was held on Tuesday, December 13, 2022,
BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law 1213PH §343-9 of 2022 is HEREBY ADOPTED as:

Announcements:
- There will be no second Board meeting in December.
- Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Monday, December 26th, 2022 and Monday, January 2nd, 2023 in observance of the Christmas and New Year’s Day Holidays. Residents should not put rubbish or recycling out to the curb on holidays.
