A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, DECEMBER 7, 2021. On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the meeting opened at 5:10 PM. On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the work session ended at 6:00 PM.

A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, DECEMBER 14, 2021. On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the meeting opened at 7:05 PM. On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the Board entered into executive session at 7:15 PM to discuss current litigation, at which time the work session was ended on the motion of Trustee Seibert, seconded by Trustee Cardali and unanimously carried. On the motion of Trustee Seibert, seconded by Trustee Cardali and unanimously carried, the executive session ended at 7:57 PM.

Regular meeting of the Board of Trustees opened at 8:00 PM.

The Pledge of Allegiance was led by Trustee Silvestri.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to approve the minutes of the November 23, 2021 regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to hire David Ambrose as a full-time highway laborer with an annual salary of $45,760 effective November 22, 2021.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to hire John Schnepp as a full-time highway laborer with an annual salary of $45,760 effective November 8, 2021.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to re-appoint Caitlin Alfano to the Architectural Review Board for a three-year term which will expire December 2024.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to re-appoint James Kanzler as an alternate member of the Planning Board for a five-year term which will expire December 2026.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to accept the attached intermunicipal agreement for shared services between the Board of Education of the Babylon Union Free School District and the Village of Babylon, for a term of July 1, 2021 through June 30, 2022,

And,

ALSO RESOLVED to authorize the mayor to execute the agreement. [Contract #1468]

    On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

    RESOLVED that the Village of Babylon will hold the 3rd Annual Pickleball Tournament June 4th and June 5th, 2022 (rain date July 30th and 31st) at the Village of Babylon tennis courts located on Park Avenue.

    On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

    RESOLVED to approve the following warrant for December 14, 2021:

    On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to re-appoint Meredith McCaslin to the Architectural Review Board for a three-year term which will expire January 2025.

    On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to accept the DRAFT Audited Financial Statements for the Village of Babylon for the Fiscal Year Ended May 31, 2021,

    And,

    ALSO RESOLVED to accept the Management Comment Letter and Corrective Action Plan for the Financial Statement Audit for Year Ended May 31, 2021.

      On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to schedule a public hearing to be held on Tuesday, January 11, 2022 at 7:00 PM to consider the adoption of proposed Local Law of 2022 to amend Village Code Chapter §343-33 to prohibit commercial vehicles from parking on Village streets overnight. Complete text of the above Local Law will be available beginning December 30th in the Office of the Village Clerk and on the Village website, www.villageofbabylonny.gov.

      On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to grant a license to the following applicant to drive a taxi cab for Lindy’s Taxi in the Village of Babylon: Paul Lagarenne

      On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to hire Lloyd Blake as full-time Assessment Clerk in the Assessor’s Office with an annual salary of $35,000 effective November 29th, 2021.

      On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to grant the application of Thomas DelFrancesco of T.D. Vending Corporation to operate a Mister Softee ice cream truck in the Village of Babylon for the 2022 season. This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed and notarized hold harmless agreement.

      On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to re-appoint Richard Tesoro to the Planning Board for a five-year term which will expire December 2026.

      On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

      On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED that the Memorandum of Agreement (MOA), dated 11/23/2021, between the Village of Babylon and the CSEA Local 1000 is approved, as per the attached.

      On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to schedule a public hearing to be held on Tuesday, January 11, 2022 at 7:00 PM to consider the adoption of proposed Local Law of 2022 to amend Village Code Chapter §210-7 C to require landscapers to remove and dispose of all landscaping debris. Complete text of the above Local Law will be available beginning December 30th in the Office of the Village Clerk and on the Village website, www.villageofbabylonny.gov.

      The mayor made the following announcements:

      - There will be no second Board meeting in December.

      - Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Friday, December 24th and Friday, December 31st, 2021 in observance of the Christmas and New Year’s Day Holidays. There will be a special pick up of holiday wrappings, etc., no recycling or large items, on Monday, December 27th for those regularly scheduled for Friday rubbish pickup. Residents should not put rubbish or recycling out to the curb on holidays.

        Mayor Adams repeated the statement made at the November 23rd, 2021 Board meeting regarding the Village’s position on the recent allegations at the Babylon School District:

        “Once again, and as I read at our last Board meeting on Tuesday, November 23rd, I want to briefly address the news of alleged abuse and misconduct within the Babylon School District. As a Village Board, and as long-time residents, we stand in solidarity against all forms of sexual harassment, abuse, or mistreatment of children within our district, and we call for a swift and full investigation into these allegations.

        The New York State Attorney General announced that she is launching an investigation into these allegations. Therefore, we have been advised by our legal counsel that we refrain from commenting directly on these allegations as an elected board, in order to avoid interference with this investigation.

        However, I know some of you may be here to speak on this matter, and you are of course still welcome to address the Board, and your comments will be made part of the official record.”
