A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, FEBRUARY 13, 2024. Present were: Mayor Adams, Trustee Seibert, Trustee Cardali, Trustee Bencivenga and Trustee Miga. Village Attorney Charles J. Casolaro was absent.
On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, the work session opened at 7:15 PM. On the motion of Trustee Seibert seconded by Trustee Bencivenga and unanimously carried, the work session ended at 8:00 PM.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to approve the minutes of the January 23, 2024 regular meeting of the Board of Trustees and dispense with the reading of the same.
The Village Clerk read the correspondence from the Fire Department dated January 16, 2024:

RESOLVED to approve the attached 2024 Summer Employment Salary schedule.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to grant permission to Babylon Jr.-Sr. High School to use the Park Avenue tennis courts (north and south side) from March 11th through June 1st, 2024, between 2:30 PM and 6:30 PM, for the Varsity, Junior Varsity and Junior High Boys Tennis teams. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

RESOLVED to accept the resignation of Office Assistant Marie Rogate, effective February 2, 2024.

RESOLVED to grant permission to the Great South Bay Amateur Radio Club to host the annual International Marconi Day activities in the North Carll Avenue municipal parking lot by Village Hall, 153 W Main Street, on Saturday, April 27, 2024, from 7:00 AM to 5:30 PM. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

To Adopt proposed local law pertaining to Special Use Permit:
RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law 0109PH §365-20; §365-21 of 2024 Special Parking Permits, and therefore,
BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment, and

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was
RESOLVED to grant permission to the Babylon Jr.-Sr. High School to use the softball field on the north side of Locust Avenue between 3:00 PM and 5:15 PM, Monday through Friday, beginning March 25, 2024 and ending June 3, 2024, for the Junior High Softball team practices. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.
On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was
RESOLVED to grant permission to St. Joseph’s Church to conduct the annual ‘Stations of the Cross’ around Argyle Lake on Good Friday, March 29, 2024 between 1:00 PM and 3:00 PM, with assistance from Village Code Enforcement. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

RESOLVED to terminate Robert Eversfield, laborer, effective January 3, 2024.

RESOLVED to grant permission to Good Samaritan University Hospital to use the Village Municipal Dock for their 3rd Annual Charity Fishing Tournament on Saturday, June 22nd, 2024, from 6:00 AM – 4:00 PM. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

WHEREAS, a Public Hearing was held on Tuesday February 13, 2024,
BE IT HEREBY RESOLVED to approve the application of Massimiliano Gargiulo of Molto Pizza, to upgrade his liquor license from beer/wine to a full liquor license and extend hours of operation at his pizzeria at 376 Deer Park Avenue. [SCTM: 0102–006–06–036]

RESOLVED to grant permission to Babylon Jr.-Sr. High School to use the Locust Avenue south field [including use of the lights, press box, and concession stand] on Friday, May 3rd, 2024 at 6:00 PM to host the 12th Annual Peter Figoski Memorial Softball Game. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

- Trustee Cardali read the following resolution, and polled the Board:
RESOLVED to authorize the Village Clerk and/or Village Treasurer to levy the village tax roll for the property of 21 Lighthouse Road, Babylon, NY,
WHEREAS, the owner of the real property of 21 Lighthouse Road, Babylon, New York, (“The Property”) has an outstanding judgment in the sum of $2,500.00 issued against him by the Village Justice Court for failure to appear and dispose of those certain quality of life Summonses; and,
WHEREAS, the Village seeks to collect on this judgment; and,
NOW THEREFORE, BE IT RESOLVED, that by this Resolution, the Board of Trustees hereby authorizes the Village Clerk and/or Village Treasurer to levy the Village Property Tax Warrant for the Property of 21 Lighthouse Road, Village of Babylon, State of New York, in the sum of $2,500.00, as an additional tax to be collected by the Village;
WHEREFOR, this RESOLUTION, hereby adopted by vote of the Board of Trustees on February 13, 2024, shall be promptly recorded in the Office of the Village Clerk, and made part of the public record.

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to grant permission to the Babylon Beautification Society to hold the 2024 Annual Fair on Sunday September 8th, 2024 (rain date September 15th, 2024), including permission to sell beverages (beer, wine, water) on the north side of Argyle Lake. This permission is granted only for the 2024 Annual Fair and is contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.
ALSO RESOLVE to grant permission to the Babylon Beautification Society the use of the Village Garage for Lamppost decorating prep on Saturday, November 30th, 2024, from 7:30 AM – 11:00 AM.

On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to grant permission to the Babylon Village Girl Scouts Service Unit #14 to use a portion of the Locust Avenue Parking lot on Sunday, February 18, 2024, from 8:00 AM – 11:00 AM to sort and distribute Girl Scout cookies. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

RESOLVED to terminate Kendrick Barrett, laborer, effective December 29, 2023.

On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to schedule a public hearing to be held on Tuesday, February 27, 2024 at 7:00 PM to consider the adoption of the below proposed Local Laws of 2024:
- Proposed Local Law 0227PH-79-1 of 2024 amending Village Code §79-1; Definitions, to add the definition of Feral animal; and,
- Proposed Local Law 0227PH-79-2 of 2024 amending Village Code §79-2 Restrictions on keeping certain animals to include Feral Cats; and,
- Proposed Local Law 0227PH-34 of 2024 amending Village Code §34-1 Officers and Employees Article V, establishing the position of Village Harbor Master; and,
- Proposed Local Law 0227PH-343-19 of 2024 amending the Village Code §343-19 to include the following; Trucking -Use Alternate Route Signs
- Proposed Local law 0227PH-365-12 of 2024, adding to the Village Code, §365-12 Parking Zone Districts.

The following announcements were made:
- · Trustee Seibert stated Easter Bunny photos will be at the Conklin House
- · Trustee Bemcivenga stated that boating season is upon us, and renewal letters are going out this week, and the golf course will open for the season soon.
- · Trustee Cardali said the Village Pool will be open Wednesday, June 26th and the Recreation Department is taking summer employment applications.
- · Trustee Miga thanked all the volunteers who help shovel for the seniors.
