A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on 

TUESDAY, FEBRUARY 28, 2023. Present were: Mayor Adams, Trustee Seibert, Trustee Cardali, Trustee Miga and Village Attorney Matthew McDonough. Absent was Trustee Bencivenga.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, the work session opened at 7:41 PM. On the motion of Trustee Seibert seconded by Trustee Miga and unanimously carried, the work session ended at 7:47 PM.

On the motion of Trustee Seibert, seconded by Trustee Cardali and unanimously carried, the Board entered into executive session at 7:48 PM to discuss human resource issues and current litigation. On the motion of Trustee Seibert, seconded by Trustee Cardali and unanimously carried, the executive session ended at 8:03 PM.

Regular meeting of the Board of Trustees opened at 8:05 PM.

The Pledge of Allegiance was led by Trustee Seibert.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

RESOLVED to approve the minutes of the February 14, 2023 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the correspondence from the Fire Department dated February 21, 2023:

At the regular monthly meeting of the Fire Council held February 21, 2023 the Fire Council took the following actions and we await your approval:

    On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

    RESOLVED to accept the Fire Department actions as read.

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to hire Marsha Collock as part time Office Assistant for the Historical Society at a rate of $11 per hour effective February 12, 2023.

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to implement the attached Driver Safety Policy.

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED for the Village to hold a Trunk or Treat & Halloween Parade on October 29th from 1-3 PM in the municipal lot behind 72 E. Main Street.

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to grant permission to the Babylon Village Chamber of Commerce to hold the 2023 events in the Village of Babylon, including sidewalk access, as per the attached. This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured, as well as signed and notarized hold harmless agreements, from the Chamber of Commerce and any vendors that participate.

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to grant permission to Race Awesome to hold the Catholic Health Services Suffolk County Marathon to benefit veterans on Sunday October 22nd, 2023. [The race will begin at 7:30 AM at the Babylon Train Station, head west on Montauk Highway, around Argyle Lake, then east on Montauk Highway to continue the race course outside the Village to Gardiner County Park. The last athlete is expected to pass Rt. 231 by 8:15 AM, at which time the Village roads will reopen.] This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to issue a refund in the amount indicated to the applicant listed below for the return of Board of Trustees sign. [Hearing date: 1/24/2023]

      On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to hire Thomas Horstmann as part time Laborer for the pool at $21 per hour, effective March 1, 2023.

      On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to extend the license between the Village and The Delica Sea, pool concessions, for the 2023 Season, per the attached License Extension.

        On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

        RESOLVED to accept the attached service agreement with Geesebusters for geese control at the golf course for the 2023 season.

          On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

          RESOLVED to grant permission to the Babylon Little League to use the Village Hall meeting room as follows: Monday, March 13, 2023 from 6:00 PM – 10:00 PM, for a CPR Certification Class run by Thad Alberti for approximately 30 people.

          On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

          RESOLVED to issue a pro-rated refund in the amount of $200.00 to Kevin Monahan for the return of Apartment Parking decal #013. (Decal expiration date: October 31, 2023)

          On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

          RESOLVED to issue a refund in the amount of $1,003.52 to David Pike for the Tax years and parcel listed, per the attached Scar Settlement dated February 16, 2023.

          On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

          RESOLVED to approve the following warrant for February 28, 2023:

          On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

          RESOLVED to hire Leofred Osbourne as a full time Laborer with an annual salary of $35,360 effective February 6, 2023.

          On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

          RESOLVED to accept the resignation of Gilberto Rivas, full time Laborer, effective February 24, 2023.

          On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

          RESOLVED to participate in NYS “I Love My Park Day” on Saturday, May 6th, 2023 at Argyle Park from 9:00 AM to Noon.

          On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

          RESOLVED to grant permission to the Babylon Jr.-Sr. High School to use the softball field on the north side of Locust Avenue between 3:00 PM and 4:30 PM beginning March 27, 2023 and ending June 3, 2023 for the Junior High Softball team practices. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

            On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

            RESOLVED to grant permission to Babylon Village Girl Scout Troop #1636 to use the Park Avenue tennis court parking lot (southeast courts) to sell Girl Scout cookies on March 4th, March 18th, April 1st, and April 18th 2023 from 1:00 PM to 4:00 PM. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured and a signed and notarized hold harmless agreement.

            On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

            Mayor Adams read the following Bond Resolution and polled the Board:

            BOND RESOLUTION OF THE VILLAGE OF BABYLON, NEW YORK, ADOPTED FEBRUARY 28, 2023, AUTHORIZING THE ACQUISITION OF SCOTT PACKS FOR USE BY THE VILLAGE FIRE DEPARTMENT, STATING THE ESTIMATED MAXIMUM COST THEREOF IS $180,000, APPROPRIATING SAID AMOUNT FOR SUCH PURPOSE, AND AUTHORIZING THE ISSUANCE OF BONDS IN THE PRINCIPAL AMOUNT OF $180,000 TO FINANCE SAID APPROPRIATION.
