A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, JANUARY 10, 2023. Present were: Mayor Adams, Trustee Seibert, Trustee Cardali, Trustee Miga, and Village Attorney Matthew McDonough. Trustee Bencivenga was absent.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, the work session opened at 7:15 PM. On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, the Board entered into executive session at 7:18 PM to discuss human resource and legal issues, at which time the work session was ended on the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried. On the motion of Trustee Miga seconded by Trustee Cardali and unanimously carried, the work session ended at 8:00 PM.

Regular meeting of the Board of Trustees opened at 8:03 PM.
The Pledge of Allegiance was led by Trustee Miga.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to approve the minutes of the December 13, 2022 regular meeting of the Board of Trustees as amended and dispense with the reading of the same.
The Village Clerk read the correspondence from the Fire Department dated December 21, 2022:

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to accept the Fire Department actions as read.
Trustee Cardali gave a special commendation to honor Gerry Hortsman for all his effort and hard work at the Village pool for over 31 years. Trustee Cardali spoke of his outstanding service
since 1991 and valued expertise with everything related to the pool. Mr. Horstman was applauded as he was presented with a proclamation plaque.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to increase the annual salary of Madison Beckman by $1,000 effective January 11, 2023, having completed her six-month probationary period.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to increase the annual salary of Benjamin Giandolfo by $1,000 effective December 27, 2022, having completed his six-month probationary period.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to amend the resolution dated December 13, 2022 and grant permission to the Ancient Order of Hibernians St. Patrick’s Division 2 to hold the annual Saint Patrick’s Day Parade on Sunday, March 19, 2023 at 2 PM.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to grant permission to the Ancient Order of Hibernians to maintain temporary signs at various merchants in the Village from January 3rd to March 19, 2023 to advertise the St. Patrick’s Day Parade to be held March 19th.

RESOLVED to remove the exemptions from the 2022 tax roll as per the attached Assessor Petitions.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to increase the advertising fee added to unpaid tax bills as of February 1st to $30.00, effective February 1, 2023.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED that the locations on the attached list are hereby designated as Polling Places for the General Village Election to be held on March 21, 2023. Polling Places will be open on said day between the hours of 7:00 a.m. and 9:00 p.m.
This Election is for Mayor and two Trustees, each for a term of four years.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED that the Village of Babylon will hold the 4th Annual Pickleball Tournament on June 10th and June 11th, 2023 (rain date July 15th and 16th) at the Village of Babylon tennis courts on Park Avenue.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law 0110PH of 2023- Veteran Parking Permits to amend Chapter §248 Parking Permits, and therefore,
BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried,
WHEREAS a Public Hearing was held on Tuesday, January 10, 2023,
BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law 0110PH of 2023-Veteran Parking Permits is HEREBY ADOPTED as:
Local Law #1 of 2023, amending Village Code Chapter §248 regarding Veteran Parking Permits.

RESOLVED to accept the DRAFT Audited Financial Statements for the Village of Babylon for the Fiscal Year Ended May 31, 2022,
And,
ALSO RESOLVED to accept the Management Comment Letter and Corrective Action Plan for the Financial Statement Audit for Year Ended May 31, 2022.
On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to accept the attached addendum to the license agreement between the Village of Babylon and The Delica Sea regarding the pool concession, approved as to form by the Village Attorney, and authorize the Mayor to execute the same.
On the motion of Trustee Cardali, seconded by Trustee Miga and unanimously carried, it was
RESOLVED that the Treasurer of the Village of Babylon be directed to hold a Tax Lien Sale at the Municipal Building, 153 West Main Street, Babylon, New York, on Saturday, the 25th of February, 2023, at 10:00 a.m.
On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to increase the annual salary of Christopher Elder by $1,000 effective December 22, 2022, having completed his six-month probationary period.
On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to terminate Richard Johnson, full-time laborer, effective December 2, 2022.
On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to grant permission to the Babylon Breast Cancer Coalition to maintain temporary signs at various merchants in the Village from January 13th to February 11th, 2023 to advertise the Super Saturday fundraiser to be held February 11th at Mary Carroll’s.
On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED that the Village establish a Safe Harbor standard measurement period of one year for a new, variable hour employee.
On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED that the Village has established a Safe Harbor standard measurement period of one year, from October 1st to September 30th, for the purpose of determining on-going variable hour employees.
On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED that the Board of Trustees will hold a public hearing at 7:00 PM on Tuesday, January 24, 2023, to consider the application of Steven Squitiro of The Standard on the Bay LLC for new covenants and restrictions and to increase the size of the Piermont, 494 Fire Island Avenue.

RESOLVED to approve the following warrant for January 10, 2023:

On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to hire Dawn Carrier as part-time office assistant at an hourly rate of $11.00 effective January 10, 2023.
Mayor Adams made the following announcement:
Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Monday, January 16th, 2023 in observance of Martin Luther King Day. Residents should not put rubbish or recycling out to the curb on holidays.
