A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, January 14, 2025. Present were: Mayor Adams, Trustee Seibert, Trustee Goodwin, and Attorney Casolaro. Absent were: Trustee Bencivenga and Trustee Cardali. On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, the work session opened at 7:05 PM. On the motion of Trustee Goodwin seconded by Trustee Seibert and unanimously carried, the work session ended at 7:09 PM. On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, the Board entered executive session at 7:10 PM to discuss HR litigation. On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, the executive session ended at 7:58 PM.

RESOLVED to approve the minutes of the December 10, 2024 regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

RESOLVED to grant permission to the Babylon Lions Club to display No Parking signs on 3 parking meters in front of Café Il Villagio, 35 Deer Park Avenue, during their take-out pasta dinner fundraiser on Sunday, February 23rd, 2025 from 1:00 p.m. to 6:00 p.m.

On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

RESOLVED to accept the enclosed contract renewal with R & R Partnership Enterprise, Inc., d/b/a Hold That Scene, for security at Babylon Village Hall effective through June 1, 2025.

On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

RESOLVED to increase the fee of Non-Resident Dock Parking to $75.00. effective January 1, 2025.

On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

RESOLVED to hold the 2025 Pickleball Tournament at the Park Avenue tennis courts on Saturday, Jume 7th from 8:00 a.m. – 5:00 p.m. and Sunday, June 8th from 8:00 a.m. – 12: 00 p.m., with a rain date of June 21st & 22nd.

On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

RESOLVED to hire Raymond Scarfi as a part time parking meter office at $15.00 per hour effective December 14, 2024.

On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

RESOLVED to hire Christian Harty as a full-time parking meter officer with and annual salary of $31,200 effective December 22, 2024.

On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

RESOLVED to grant permission to the Babylon Village Arts Council to use Argyle Park, the area in front of playground, east of the September 11th Memorial, on Saturday, May 17th, 2025, from 10:00 a.m. to 4:30 p.m. (rain date Sunday May 18th, from 11:00 a.m. to 4:30 p.m.) for the 17th Annual Art by the Falls outdoor art exhibit. This permission is granted contingent upon timely receipt of the required certificate of insurance with the Village of Babylon listed as an additional insured and a signed & notarized hold harness agreement.

And

RESOLVED to grant permission to the Babylon Village Arts Council to display 3 - 24” x 36” temporary signs at the entrances to the Village to promote the Art by the Falls event from May 1st through May 18th, 2025.

    On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED to increase the fee for Gazebo usage to $225.00 effective January 2, 2025.

    On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED to remove the fee for Pictures in Argyle Park effective January 2, 2025.

    On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED to increase the annual salary of Charles LaPera by $1,000 effective January 2, 2025, having completed his six-month probationary period.

    On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED to increase the annual salary of Raymond Toomer by $1,000 effective January 7, 2025, having completed his six-month probationary period.

    On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED to grant permission to Lodestar Children’s Services Inc. to hold a “Milestones for Mental Health” wellness walk on Saturday. May 3rd, 2025 (rain date Sunday, May 4th). Setup would begin at 7:00 AM, with the walkers arriving at 8:45 AM. The route would start at the Gazebo, through the streets of Babylon Village (route attached), to kick off Mental Health Awareness Month. At the conclusion of the walk, they would like use of the Gazebo to set up vendors with food and non-alcoholic drinks, with music and short speeches, closing at 2:00 PM.

    This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured, as well as signed and notarized hold harmless agreements from Lodestar Children’s Services Inc. and any vendors that participate.

    On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED to hold a bid opening on Thursday, February 6, 2025 at 9:30 AM for the Requirements Contract for Drainage Work. Bid Specifications will be available in the Office of the Village Clerk between the hours of 9AM and 5PM Monday through Friday beginning January 23rd, 2025.

    Trustee Seibert read the following and polled the Board:

    RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law 0227PH-34 of 2024 amending Village Code §34-1 Officers and Employees Article V, establishing the position of Village Harbor Master, and therefore,

      BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment, and

      WHEREAS a Public Hearing was held on Tuesday, February 27, 2024,

      BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law 0227PH-34 of 2024 amending Village Code §34-1 Officers and Employees Article V, establishing the position of Village Harbor Master, is HEREBY ADOPTED as:

      On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to grant permission to the Babylon Lions Club to maintain the following temporary signs from February 8th through February 23rd to advertise their take-out pasta dinner fundraiser to be held on Sunday, February 23rd, 2025 at Café Il Villagio, 35 Deer Park Avenue:

      • 8 ½” x 11” signs at various merchants in the Village
      • 4’ x 4’ signs at the entrances to the Village

      On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to increase the fee of Non-Resident Crabbing Permits to $75.00, effective January 1, 2025.

      On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to hire Giovanni D’Angelo as a full-time laborer with an annual salary of $45,760 effective December 16, 2024.

      On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to hire Donald Cembrale as a full-time laborer with an annual salary of $35,360 effective December 9, 2024.

      On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to increase the salary of James Hanley, full time laborer, to $45,760 for obtaining a CDL license, effective December 16, 2024.

      On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to hire Tyrone Jackson as a part time parking meter office at $15.00 per hour effective December 14, 2024.

      On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED that the Treasurer of the Village of Babylon be directed to hold a Tax Lien Sale at the Municipal Building, 153 West Main Street, Babylon, New York, on Saturday, the 22nd of February, 2025, at 10:00 a.m.

      On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to change Paul Meyer from full time to part time parking meter officer effective January 13, 2025.

      On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to renew the term of Meredith Michaels for another 3 years (January 2028) for the Architectural Review Board effective January 7, 2025.

      On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to hire James Bender as a part time parking meter officer with an hourly rate of $15.00 effective January 11, 2025.

      On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to schedule a Public Hearing to be held on Tuesday, January 28th, 2025 at 7:00 PM to consider the following:

      A. An Application by Frankie Bragaglia and Babylon Crew LLC., for a Special Use Permit to open and operate a lounge/restaurant and a pickle ball court to be located at the address of 96 E. Main Street, Babylon, New York 11702;

      B.   A proposed local law prohibiting the establishment of retail stores that sell firearms within the territorial boundaries of the Village of Babylon;

      C.   Proposed Local Law 0128PH of 2025– Tax Cap, authorizing a property tax levy increase more than the limit established in General Municipal Law §3-c.

      On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to grant permission to M. Roman to hold a Pride Parade on Sunday, June 1, 2025. Meet-up will begin at 1:30 p.m. at the Fitness Incentive rear parking lot, 157 Deer Park Avenue. Announcements and sponsor recognition will be at 2:30 p.m. and the car parade is expected to start at 3:00 p.m. The parade will complete one loop, escorted by Village Code Enforcement, concluding with Post Awards announcements at 3:45 p.m. Permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured and a signed and notarized hold harmless agreement.

      On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to grant permission to the Babylon Methodist Church to display temporary 8 ½” x 11” signs throughout various Village businesses from January 15th through February 1st, 2025 to promote their Ecumenical Hymn Sing event.

      On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to approve the attached Warrant for January 14, 2025:

      The following announcements were made:

      • Trustee Seibert stated the playground at Lewis Circle is installed and a bench is being dedicated. New equipment for the George Street playground was ordered and should be installed early Spring. Also, Summer Recreation programs plans are underway and applications will be coming soon.
      • Trustee Goodwin shared that we had a great Christmas at the Conklin House and thanked the Babylon High School band for playing outside for hours in the cold and thanks to Christie at the Herald for all the articles covering the events. Trustee Goodwin also announced the following upcoming events:
        • April 5th – Dinner for 8
        • May 4th – Tea, sponsored by BesTea
        • Reopening Conklin House for house tours on the 3rd Thursday of each month, beginning in February, from 12:00 – 1:00 p.m.

      The meeting was opened to the public and the no one addressed the Board.
