A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, January 28, 2025. Present: Mayor Adams, Trustee Seibert, Trustee Bencivenga, Trustee Goodwin, and Attorney Casolaro. Absent: Trustee Cardali. On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, the work session opened at 6:45 PM. On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, the work session ended at 7:00 PM.

Regular meeting of the Board of Trustees opened at 8:15 PM.

The Pledge of Allegiance was led by Marshall Price, Boy Scout.

On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

RESOLVED to approve the minutes of the January 14, 2025 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk stated there was no correspondence.

    On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED that the Board of Trustees or a majority thereof shall constitute the Board of Review to hear complaints in relation to assessments on Tuesday, February 18, 2025 at the Municipal Building, 153 West Main Street, Babylon, New York, between the hours of 3:00 P.M. and 7:00 P.M. Eastern Standard Time.

    On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED to hire Hank Carpenter to give pickleball lessons at the Park Avenue tennis courts on various days, starting April 28th, ending July 29th, 2025.

    On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED terminate full time laborer Donald Cembrale effective January 8, 2025.

    On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED to grant permission to the Babylon Lions Club to hold their Annual Fundraiser Barbeque at the Village Pool on Saturday, July 26th, 2025, from 6:00 p.m. – 11:00 p.m., with the proceeds going to local food pantries. Permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed and notarized hold harmless agreement.

    On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED to grant permission to the Great South Bay Amateur Radio Club to host the annual International Marconi Day activities in the North Carll Avenue municipal parking lot by Village Hall, 153 W Main Street, on Saturday, April 26, 2025, from 7:00 a.m. to 5:30 p.m. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured and a signed & notarized hold harmless agreement.

    On the motion of Trustee Seibert, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED that the Receiver of Taxes for the Village of Babylon be authorized to close the Tax Year 2024-2025 on January 28, 2025, and return the Tax Roll and Warrant.

    On the motion of Trustee Bencivenga, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED to remove the exemptions as per the attached Assessor Petitions and bill the current owner(s) the Exempt Property Restoration for the Tax Year(s) as indicated on the attached chart:

    On the motion of Trustee Bencivenga, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED to hold Shred Day on Saturday, April 26th, 2025 from 9:00 a.m. – 12:00 p.m.

    On the motion of Trustee Bencivenga, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED to grant permission to the Babylon Lions Club to maintain temporary 8 ½ x 11” window signs at local merchants and 5 large signs around the Village from April 20th to May 4th, 2025, to advertise their pancake breakfast on May 4th, 2025. [The Village Highway Department will assist in displaying the 5 large signs around the Village.]

    On the motion of Trustee Bencivenga, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED to grant permission to Save the Great South Bay to conduct the “9th Annual Babylon Village Community Creek Clean Up” at Carll’s River on Saturday, March 15th, 2025 from 8:00 a.m. to 12:00 p.m., with welcoming ceremony beginning at 9:00 a.m. [The Village Sanitation Department will pick up the garbage at designated spots upon completion of the clean-up.]

    On the motion of Trustee Bencivenga, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED to approve the following warrant for January 28, 2025.

    On the motion of Trustee Bencivenga, seconded by Trustee Goodwin and unanimously carried, it was

    RESOLVED to increase the Resident Boat Ramp fee to $50 per year effective January 27, 2025.

    Trustee Bencivenga read the following and polled the Board.

    RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed new Local Law, Chapter 117- Firearm Use and Sales, and therefore,

    BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment.

    WHEREAS a Public Hearing was held on Tuesday, January 28, 2025,

    BE IT HEREBY ENACTED that the following Local Law, proposed new Local Law Chapter 117 – Firearm Use and Sales, is HEREBY ADOPTED as:

    On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to hold Babylon Village’s Annual Groundhog Day on February 2nd, 2025 at 7:00 a.m. at the Park Avenue playground.

    On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to grant permission to the Babylon Little League to hold the annual Opening Day Parade at 10:00 a.m. on Saturday, April 5, 2025. The parade will start at the Fire House parking lot, head south on North Carll Avenue to Main Street; East on Main Street to Deer Park Avenue; north on Deer Park Avenue to Railroad Avenue; west on Railroad Avenue to North Carll Avenue; north on North Carll Avenue to Locust Avenue; west on Locust Avenue to the Locust South field, where the ceremony will start at approximately 11:00 AM. This permission is granted contingent upon timely receipt of required certificate of insurance with the Village of Babylon listed as an additional insured, as well as a signed and notarized hold harmless agreement.

    On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to grant permission to the Babylon Interfaith Clergy Cluster to hold a short prayer service lakeside at Argyle Park, on Thursday, May 1st, 2025 from 6:00 p.m.- 6:30 p.m. for “National Day of Prayer”. This permission is granted contingent upon timely receipt of required certificate of insurance with the Village of Babylon listed as an additional insured, as well as a signed and notarized hold harmless agreement.

    On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED grant permission to the Babylon Village Chamber of Commerce to hold their 2025 events in the Village of Babylon, including sidewalk access, as per the attached. This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured, as well as signed and notarized hold harmless agreements from the Chamber of Commerce and any vendors that participate.

    New President of the Chamber of Commerce, Thomas Vitale announced the Chamber’s 2025 Events.

    On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to accept the attached contract renewal for the Street Lighting Agreement between the Town of Babylon and the Village of Babylon for the year January 1, 2025 through December 31, 2025. [#1487]

    On the motion of Trustee Goodwin, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to appoint Election Inspectors and Alternates for the Village Election to be held March 18, 2025 as per the attached list. Payment for the day will be $160, with an additional $10 for Poll Clerks and the Chairperson at each Election District. The Board approves the use of non-village residents as Election Inspectors, but they must be residents of Suffolk County.

    Trustee Goodwin read the following and polled the Board.

    RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law 0128PH of 2025 - Tax Cap, and therefore,

    BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment.

    WHEREAS a Public Hearing was held on Tuesday, January 28, 2025,

    BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law 0128 of 2025- Tax Cap is HEREBY ADOPTED as:

    Local Law # 3 of 2025, authorizing a property tax levy more than the limit established in General Municipal Law §3-c.

    The following announcements were made:

    • Trustee Seibert stated the Lewis Circle playground will be ready for Spring and the George Street playground has new equipment ordered. We are also working on the Summer Concert schedule at the Gazebo, more information to follow.
    • Trustee Bencivenga stated we are preparing for golf season. Golf camp registration is Apil 12, 2025 in Village Hall. Applications for boat slip renewals will be mailed mid-February.
    • Trustee Goodwin stated the following upcoming events at the Conklin House:
    • -April 5th – Dinner for 8 
    • May 4th – Tea, sponsored by BesTea

    The meeting was opened to the public and the following people addressed the Board;
