A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, JANUARY 9, 2024. Present were: Mayor Adams, Trustee Seibert, Trustee Bencivenga, and Trustee Miga. On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, the work session opened at 7:39 PM. On the motion of Trustee Seibert, seconded by Trustee Bencivenga, and unanimously carried, the work session ended at 8:00 PM.

Regular meeting of the Board of Trustees opened at 8:02 PM.
The Pledge of Allegiance was led by Trustee Miga.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to approve the minutes of the December 12, 2023 regular meeting of the Board of Trustees and dispense the with the reading of the same.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED for the Village of Babylon to hold the 5th Annual Pickleball Tournament June 1st and June 2nd, 8:00 AM - 5:00 PM (rain date June 29th and June 30th), at the Village of Babylon tennis courts located at Park Avenue.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to hold the 2nd Annual St. Patrick’s Day Parade on March 24th, 2024 at 2:00 PM.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to increase the salary of Hank Carpenter, Pickleball Instructor, to $18.00 per hour for the 2024 season.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to hold Babylon Village’s 1st Annual Groundhog Day on February 2, 2024 at 7:00 AM at Argyle Park.
On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to issue a refund in the amount of $8.55 to Nancy M. Ludwig for overpayment of 2023-2024 taxes for parcel SBL 003-01-001 (45 Pond Place).
On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED that the Treasurer of the Village of Babylon be directed to hold a Tax Lien Sale at the Municipal Building, 153 West Main Street, Babylon, New York, on Saturday, the 24th of February, 2024, at 10:00 AM.
On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to grant permission to the Long Island Yacht Club to erect a seasonal tent for various events held at the Yacht Club from March 15, 2024 to December 15, 2024. Tent size is not to exceed the 35’ wide x 75’ long concrete pad. This permission is granted contingent upon the Long Island Yacht Club acquiring the proper tent permit from the Building Department to expire December 31st, 2024. Board of Trustees approval is required for all renewal permits.
On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to hold Shred Day on April 20th, 2024 from 9:00 AM – 12:00 PM.
On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

WHEREAS in violation of Village Code, the stated properties are neglected and accordingly represent a public nuisance, and
WHEREAS the Village Building Department has reported these conditions represent a nuisance in violation of Village Code,
BE IT RESOLVED that pursuant to Village Code Section 237, the Village of Babylon is authorized to remediate the offending nuisance conditions on these properties, and the Village of Babylon will be billing the owner of record.

RESOLVED to approve budget transfers to the 2022/23 budget as attached.

Mayor Adams read the following Resolution and polled the Board:
INTERMUNICIPAL AGREEMENT WITH THE SUFFOLK COUNTY PLANNING COMMISSION
WHEREAS General Municipal Law (GML) § 239 requires the referral of certain proposed planning and zoning actions to the Suffolk County Planning Commission by local Towns and Villages within the County, and
WHEREAS GML also allows for the County to enter into an agreement with a referring body or other duly authorized body of a Town or Village to provide that certain proposed actions be deemed matters of local rather than inter-community or county-wide concern and, therefore, not subject to referral, and
WHEREAS the Village of Babylon has proposed a litany of actions which are consistent with the intent of GML and represent matters of local not county-wide concern, and
WHEREAS the adoption of an inter-municipal agreement would streamline the referral review process without any compromise to county-wide or inter-community planning considerations, now therefore be it
RESOLVED that pursuant to the above, the Suffolk County Planning Commission considers the following list of actions to constitute matters of local determination which are NOT subject to the referral process:
All area variances associated with single-family residences.
Change of one permitted use to another with no changes in parking requirements (i.e. retail to office).
Minor additions less than 1,000 square feet with no change to use or occupancy.
Site plan applications proposing less than 5,000 square feet of new or renovated floor area or less than 10,000 square feet of land disturbance.
Exception – actions that have been given a Positive Declaration pursuant to SEQR or actions involving property abutting state or county parkland, the Atlantic Ocean, Long Island Sound, any bay in Suffolk County or estuary of any of the foregoing bodies of water shall be subject to the full review process.
RESOLVED that the Village Clerk is directed to forward a copy of this resolution to the Suffolk County Planning Commission and to the Planning Board and Zoning Board of Appeals of the Village of Babylon

Trustee Miga thanked the 15 volunteers and 15 kids that helped shovel.
Trustee Seibert working on summer recreation programs and line up for the Gazebo concerts.
Trustee Bencivenga stated been quiet, nothing to report.
Mayor Adams thanked Sanitation and Highway for help with the new sanitation calendar.
