A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, JUNE 11, 2024. Present were: Mayor Adams, Trustee Seibert, Trustee Cardali, Trustee Bencivenga, and Trustee Miga; Absent: Village Attorney Charles J. Casolaro. On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, the work session opened at 7:00 PM. On the motion of Trustee Seibert, seconded by Trustee Bemcivenga and unanimously carried, the work session ended at 7:59 PM.

Regular meeting of the Board of Trustees opened at 8:02 PM.

The Pledge of Allegiance was led by Trustee Miga.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

RESOLVED to approve the minutes of the May 28, 2024 regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

RESOLVED to schedule a public hearing to be held on Tuesday, June 25th, 2024 at 7:00 PM to consider:

  • The application of Peter Phelan, member of DHT Babylon, Inc. to open a full-service restaurant and bar at the location of the Argyle Grill, at 90 Deer Park Avenue, and
  • Adoption of proposed Local Law 0628PH of 2024; §365-20J-Facade Improvement Committee – To establish a Façade Improvement Committee.

Copy of application and plans of the proposed local law may be examined at the Office of the Village Clerk, between the hours of 10am and 4pm Monday through Friday.

Trustee Siebert read the following Resolution and polled the Board:

WHEREAS, Section 72-h of the General Municipal Law of the State of New York permits the sale of real property between municipal governments in the State of New York; and

WHEREAS, there is a parcel owned by the County of Suffolk located at 58 East Main Street, Babylon, further identified as SCTM 0102-014.00-02.00-008.000; and

WHEREAS, the Village of Babylon is interested in acquiring said parcel of real property for public parking to benefit the Village for a total consideration not to exceed $61,772.01 for the property to be paid to the County of Suffolk; and

WHEREAS, the Village Board of the Village of Babylon is aware that the subject premises shall be conveyed subject to certain restrictive covenants that will run with the land so conveyed, including that the parcel shall be conveyed solely for the public purposes, such as the parking lot presently intended; and

WHEREAS, the Village Board of the Village of Babylon is aware that the restrictive covenants described above will run with the land and shall bind the heirs, successors, and assigns of the Village of Babylon and in the event of any violations of the restrictive covenants stated above, the Deed conveying said parcel shall be void ab initio and title to the realty shall revert to the County of Suffolk;

BE IT THERFOR RESOLVED the Village of Babylon hereby requests the conveyance of the following property located at 58 East Main Street, Babylon, further identified as SCTM 0102-014.00-02.00-008.00, for the total consideration of $61,772.01 to be paid to the County of Suffolk.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to grant permission to the Chamber of Commerce to maintain temporary signs at the locations listed below from June 13th through August 22nd (or August 29th if rain date needed), to advertise the Babylon Block Parties on June 27th, July 25th and, August 22nd.

  • Locations to display signs:
  • Entrance to VOB at 109 and Montauk Highway, 36” x 48” Signage
  • Entrance to VOB at end of 231 and Montauk Highway, 36 x 48 Signage
  • 3 signs - 24” x 36”, to be displayed within Babylon Village, accordingly
  • Posters - 11” x 17”, to be distributed to the VOB establishments to display on windows.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to change the employment status of Patricia Duryea from part time Parking Meter Officer to Office Assistant, effective June 3, 2024.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to grant permission to the residents of Bay Street to hold a block party on Saturday, July 27, 2024 from 12:00 PM to 7:00 PM with a rain date of July 28, 2024. The street will be blocked between Cedar Lane and Araca Court, subject to parking restrictions for emergency purposes.

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to grant permission to Bicycle Shows U.S. to hold their 60th Anniversary ‘Ride to Montauk’ bicycle event from the Babylon Long Island Railroad Station to Montauk on Saturday, September 14th, 2024, from 5:00 AM- 10:00 AM and Sunday, September 15th, 2024, 12: 00 PM – 2:00 PM.

This permission is granted contingent upon timely receipt of the required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured” as well as a signed and notarized Hold Harmless agreement.

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to approve the following warrant for June 11, 2024:

                                             GENERAL ACCOUNT:                  $ 387,330.03

                                        TOTAL GENERAL FUND:                   $ 387,330.03

                                                      CAPITAL FUND:                   $   91,160.34

                                                                    TOTAL:                    $ 478,490.37


On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to issue a refund in the amount of $175.49 to John Walsh for overpayment of 2024-2025 taxes on the property located at 214 Woodsome Road. [S/B/L 015/ 02/013]

On the motion of Trustee Miga, seconded by Trustee Siebert and unanimously carried, it was

RESOLVED to accept the resignation of Daniel Bonge, part time Code Enforcement Officer, effective immediately.

On the motion of Trustee Miga, seconded by Trustee Siebert and unanimously carried, it was

RESOLVED to make the assessment correction as per the attached Assessor Petition:

         214 Woodsome Road [Section 015/ Block 02/ Lot 013]

The following announcements were made:

    • · Trustee Siebert noted there is and Ice Cream Social at the Conklin House at 6:30 PM and the concert at the Gazebo, this Thursday, 6/13/2024
    • · Trustee Bencivenga stated the Golf Course is doing well. Leagues are Tuesday/Wednesday/Thursday mornings, but now open to the public at 1:00PM. Docks are doing well, wrapping up boating slips for the season
    • · Trustee Cardali stated pool opening day is Wednesday, June 26 at 12:00PM. Everything looking great. Total passes sold; 240 Family Passes, 17 Adults Passes, 8 Children’s Passes; 70 Senior Passes, 20 Sunrise Swim passes. There are 185 Children enrolled in swim lessons and 30 children registered for the Swim team, with swim meet late July.
    • · Trustee Miga noted that the Beautification Society is preparing for the upcoming Christmas season.

    The meeting was opened to the public and the following person addressed the Board;

    On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, the meeting adjourned at 8:19 PM.
