A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, JUNE 14, 2022. On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the meeting opened at 7:10 PM. On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the Board entered into executive session at 7:28 PM to discuss personnel issues, at which time the work session was ended on the motion of Trustee Seibert and seconded by Trustee Silvestri.

Regular meeting of the Board of Trustees opened at 8:04 PM.

The Pledge of Allegiance was led by Trustee Cardali.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to approve the minutes of the May 24, 2022 regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to hire Linda Zimmerer as a part-time office assistant for the Building Department at an hourly rate of $11.00 effective May 23, 2022.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to promote Christine Becker to Deputy Court Clerk with an annual salary of $44,000 effective May 30, 2022.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to accept the request of Patricia Broderick to retire from the Village of Babylon effective May 27, 2022.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant permission to the residents of Bacon Lane to hold a block party on Saturday, July 9, 2022, from Noon to 11:00 PM, with a rain date of Sunday, July 10, 2022. The street will be blocked between East Gate and Nehring Avenue, subject to parking restrictions for emergency purposes.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant permission to the Babylon Lions Club to maintain temporary signs at various merchants and around the Village from July 15th through July 29th, 2022 to advertise the 9th Annual Babylon Lions Summer Barbeque to Fight Hunger on July 29th at the Village Pool.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant permission to Babylon Citizens Council on the Arts to hold a summer workshop, Landscape Painting in Oil with artist Barbara Zanelli, at Argyle Park on Saturday, July 9, 2022, from 9:00 AM to 5:00 PM, with a rain date of Sunday, July 10, 2022. This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured and a signed and notarized hold harmless agreement.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to refund Roberta Pizzo $175 for use of the gazebo.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED that the Open Container Section of the Village Code, Chapter 256, is hereby waived for the Annual Country Fair to be held on September 18, 2022, with a rain date of September 25, 2022. This pertains to the Gazebo area of Argyle Park and the north side of Argyle Lake (by Trolley Line Road) for the 2022 Annual Country Fair only.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed local law 365-20 H of 2022 amending Chapter §365-20 H Retail Business Districts,

and therefore,

BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, June 14, 2022,

BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law 365-20H of 2022, is HEREBY ADOPTED as:

Local Law #6 of 2022, amending Chapter §365-20 H to prohibit vinyl siding in Retail Business Districts

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to hire Henry Naulaguari as a highway laborer with an annual salary of $45,760 effective May 2, 2022.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to hire Gilberto A. Rivas as a highway laborer with an annual salary of $45,760 effective May 2, 2022.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to grant permission to the residents of Cadman Avenue to hold a block party on Monday, July 4, 2022, from 10:00 AM to 11:00 PM. The street will be blocked between Beverly Road and Marlborough Road, subject to parking restrictions for emergency purposes.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to grant permission to the Chamber of Commerce to hold a mini-golf fundraiser in the business district on Saturday, September 24, 2022 from 9:00 AM to 5:00 PM. A list of participating businesses will be provided prior to the event date. This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured and a signed and notarized hold harmless agreement.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to grant permission to the Chamber of Commerce to maintain temporary signs at the locations listed below from July 1 through September 15, 2022 to advertise the Babylon Block Parties on July 14 & 28, August 11 & 25 and September 15.

Locations to display signs:

  • Intersection of John Street/ Cooper Street/ Simon Street
  • Deer Park Avenue near Cross of Christ Church
  • Main Street by the Rt. 231 intersection
  • Main Street & Rt. 109 intersection (near the Greenman Pedersen Building)

    On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried,

    WHEREAS a Public Hearing was held on Tuesday, May 24, 2022,

    BE IT HEREBY RESOLVED to approve the application of Patrick Mack of Cobra Restaurant Group LLC to open a restaurant, Mack’s, at 94 East Main Street, the former location of Culture Fine Food and Cocktails, contingent upon covenants and restrictions to follow at a later date. [Section 014 / Block 02 / Lot 011]

      On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to approve the following warrant for June 14, 2022:

      On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to approve the License Agreement, approved as to form by the Village Attorney, with Shannondoah LLC and authorize the Mayor to execute the same.

      On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to hire Dawn Carrier as a part-time golf starter at an hourly rate of $9.25 effective June 6, 2022.

      On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to hire James Mitchell as a part-time golf starter at an hourly rate of $9.25 effective June 6, 2022.

      On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to increase the annual salary of Marybeth Briordy Liles $1,000 effective June 6, 2022, having completed her six-month probationary period.

      On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to grant permission to the residents of Cockenoe Avenue to hold a block party on Saturday, September 10, 2022, from 3:00 PM to 11:00 PM. The street will be blocked between Wampum Road and Wyandanch Avenue, subject to parking restrictions for emergency purposes.

      On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to issue a pro-rated refund in the amount of $510.00 to Joann Holgan as she will not be using her Boynes Canal boat slip #3017 for the remainder of the 2022 season.

      On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to approve a professional service agreement, approved as to form by the Village Attorney, with Michael Gioso to provide professional golf pro services and authorize the Mayor to execute same.

      On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to schedule a public hearing to be held on Tuesday, July 12, 2022 at 7:00 PM to consider the adoption of proposed Local Law 343-67 of 2022 to amend Village Code Chapter 343-67 Stop Intersections. Complete text of the above proposed local law will be available beginning June 30, 2022 in the Office of the Village Clerk and on the Village website, www.villageofbabylonny.gov.

        On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, it was

        RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed local law of 2022 amending Chapter 281-8

        and therefore,

        BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment.

        On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried,

        WHEREAS a Public Hearing was held on Tuesday, June 14, 2022,

        BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law of 2022 Chapter §281-8 is HEREBY ADOPTED as:

        Local Law #7 of 2022, amending Chapter 281-8 regarding the term of permits on Rental Properties.
