On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the meeting opened at 7:08 p.m.  On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the Board entered into executive session at 7:13 p.m. to discuss current litigation, at which time the work session was ended on the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried.  On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, the executive session ended at 8:01 p.m.

Regular meeting of the Board of Trustees opened at 8:03 PM.

The Pledge of Allegiance was led by Trustee Bencivenga.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to approve the minutes of the June 8, 2021 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the letter from the Fire Department dated June 16, 2021:

At the regular monthly meeting of the Fire Council held June 15, 2021, the Fire Council took the following actions and we await your approval:

Placed on Sick Leave:

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to accept the Fire Department actions as read.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to accept the resignation of Kristina Everitt as a part-time employee in the Village Clerk’s Office and as Secretary to the Zoning Board of Appeals effective January 23, 2021.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to issue a refund in the amount of $1,791.93 to Charles Ferrara for duplicate payment of 2021 Village taxes for the property located at 53 Ketewamoke Avenue.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to issue a refund in the amount of $78.25 to Rhumbline Management, LLC, for overpayment of 2021 Village taxes on the property located at 133 E. Main Street, Suite 2E, due to the incorrect assessed value on the 2021 tax roll.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to issue a refund in the amount of $78.25 to Rhumbline Management, LLC, for overpayment of 2021 Village taxes on the property located at 133 E. Main Street, Suite 2F, due to the incorrect assessed value on the 2021 tax roll.

[Section 010.1/ Block 02/ Lot 003]

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried,

WHEREAS; the property designated by Suffolk County Tax Map District 102, Section 002, Block 01, Lot 016, located on Marlborough Road in the Village of Babylon, NY, has not been occupied by the owner of record, and has not been maintained by the owner of record and,

WHEREAS; the property is unkept and overgrown, and accordingly represents a public nuisance and,

WHEREAS; the Village Building Department has reported these conditions represent a nuisance and dangerous situation in violation of Village Code, and,

WHEREAS; the property owners of record have been notified of this violation and directed to cure this violation by June 15, 2021, and the owner failed to properly abate and the property remains a nuisance,

BE IT HEREBY RESOLVED that pursuant to Village Code Section 237-2, the Village of Babylon is authorized to remediate the offending nuisance and dangerous condition and assess the costs on the property tax bill.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to accept the resignation of Ryan Flynn as part-time highway laborer effective June 6, 2021.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to issue a refund in the amount of $94.00 to Jarrett Fifield for permanently switching from a 15’ wide boat slip #4019 in East Creek to a 12’ wide boat slip #4092 in East Creek.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to issue a pro-rated refund in the amount of $377.00 to Dennis Stefanak as he will no longer be using boat slip #4092 on East Creek.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to correct the assessments on the 2021 Tax Roll for the parcels listed below as per the attached Assessor Petitions.

RESOLVED to approve the following warrant for June 22, 2021:

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to grant permission to the residents of Coppertree Lane to hold a block party on Sunday, July 11, 2021, from 11:00 AM to 11:00 PM, with a rain date of Sunday, July 18, 2021.  The street will be blocked between Crescent Avenue and Cedar Lane, subject to parking restrictions for emergency purposes.

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to remove the Veteran exemption granted to John Latza for the property located at 11 Bradish Lane [008-01-150], as per the attached Assessor Petitions, and bill the new owners, Ali Sleiman and Tana Ali Tamer, the exempt property restoration for the tax years indicated.

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried,

WHEREAS; the property designated by Suffolk County Tax Map District 102, Section 022, Block 02, Lot 029, 167 Annuskemunnica Road, in the Village of Babylon, NY, has not been occupied by the owner of record, and has not been maintained by the owner of record and,

WHEREAS; that several bins of canine feces are stored on the property posing a health risk to residents and violation of the Village Code, and accordingly represents a public nuisance and,

WHEREAS; the Village Building Department has reported these conditions represent a nuisance and dangerous situation in violation of Village Code, and,

WHEREAS; the property owners of record have been notified of this violation and directed to cure this violation by June 25, 2021;

BE IT HEREBY RESOLVED that pursuant to Village Code Section 237-2, the Village of Babylon is authorized to remediate the offending nuisance and dangerous condition and assess the costs on the property tax bill if the homeowner does not abate the nuisance by June 25, 2021.

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to increase the fee for pool parties at the Gilbert C. Hanse Municipal Pool to $600.00 per event, effective June 26, 2021.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant permission to the Babylon Beautification Society to use the following areas for the Annual Fair on Sunday, September 12, 2021 (rain date September 19, 2021):

-          Argyle Park, including areas north, east, and south of Argyle Lake for craft vendors

-          Argyle Park Parking lot, for “Specialty Food Market” for the sale of pre-made, pre-packaged, specialty food items.

-          Village Gazebo and surrounding area

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to approve Dana Gervasi, at a rate of $13.00 per hour, to instruct the summer recreation program, Cooking with Chef Dana, for one hour on Thursdays, beginning

July 1st and ending August 5, 2021.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to approve Hank Carpenter, at a rate of $17.00 per hour, to teach Pickleball lessons for beginners, for two sessions, 2 hours each session, on the following dates:

            July 19th and 20th

            August 9th and 10th

            September 20th and 21st

            October 18th and 19th

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to assume lead agency status pursuant to SEQRA concerning proposed Local Law 8 of 2021 and issue a negative declaration pursuant to SEQRA.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, June 8, 2021,

BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law 8 of 2021, is HEREBY ADOPTED as:

Local Law 8 of 2021, to amend Village Code Chapter 210-Landscapers, §210-7 C. Regulations and §210-8. Penalties for Offenses

**This Local Law is effective upon filing with the Secretary of State**

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED that the Open Container Section of the Village Code, Chapter 256, is hereby waived for the Annual Country Fair to be held on September 12, 2021, with a rain date of September 19, 2021.  This pertains to the Gazebo area of Argyle Park.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried,

WHEREAS; the Village Pool and its parking lot is a valuable asset to the Village and its residents and,

WHEREAS; the Board of Trustees wishing to secure such assets for the benefit of Village residents wishes to designate the Village Pool parking lot a limited parking field pursuant to the Village Code, and,

WHEREAS; pursuant to Section 343-45 of the Village Code the Board of Trustees may by resolution designate a parking field as limited;

BE IT HEREBY RESOLVED that pursuant to Village Code Section 343-45, the Village of Babylon by resolution designates the Village Pool parking lot as a limited parking field which shall take effect immediately; and,

BE IT FURTHER RESOLVED that Village residents may obtain a parking permit from the Office of the Village Clerk for no fee and non-residents of the Village may obtain a parking permit from the Office of the Village Clerk for a fee of $50.00 for the limited parking field at the Village Pool.

Mayor Adams made the following announcement:

Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Monday, July 5th, 2021, in observance of the Independence Day Holiday.  Residents should not put rubbish or recycling out to the curb on holidays.

Trustee Cardali reminded everyone that fireworks are illegal in the State of New York; in the interest of fire safety and personal safety, please do not light off fireworks.
