The Pledge of Allegiance was led by Trustee Bencivenga.

The Village Clerk read the legal notice:

NOTICE IS HEREBY GIVEN that the Board of Trustees of the Village of Babylon will hold a Public Hearing at 153 West Main Street, on Tuesday, May 24, 2022, at 7:00 p.m. or as soon thereafter as can be heard to consider the application of Patrick Mack of Cobra Restaurant Group LLC, to open a restaurant at 94 East Main St., the former location of Culture Fine Food & Cocktails.

Copy of application and plans may be examined at the office of the Village Clerk, between the hours of 10:00 AM and 4:00 PM Monday through Friday.

All interested persons should appear at the above time and place and they will be given the opportunity to be heard. All applicants and their duly appointed representatives must appear in person at the above hearing.

Patrick Mack addressed the Board to explain his intention to open a restaurant called ‘Macks’ with the primary focus being breakfast and lunch, similar to Toast in Bay Shore and Jam in Massapequa. He would also like to cater private parties, such as birthdays, showers, corporate events, etc. after regular business hours.

The regular hours of operation for breakfast and lunch would be 7:00 AM to 4:00 PM, seven days a week. Dinner would not be served unless it was for a private catered event. If not scheduled during regular business hours, private events would be scheduled between 6:00 PM and 11:00 PM Monday through Thursday and 6:00 PM and 1:00 AM Friday through Sunday.

All business would be conducted indoors; nothing would be served outdoors. Parties could be scheduled on both floors, depending on the size of the party. There is no bar on the second floor, just sinks and an ice maker. The seating would remain the same as it was when operating as Culture Fine Food and Cocktails, with 48 seats on each floor and 9 seats at the bar. They may possibly schedule more than one event at a time if the events are small, seating is available for the entire party, and if adequate staffing is available. Timing of multiple events would be staggered. Music would be limited to a jukebox or acoustic music only.

Mr. Mack stated that he would like to open within the next month and a half.

The Board expressed concern over the late hours for private events and Mr. Mack assured them that this was not going to be a catering hall.

The Board emphasized that the back area outside the restaurant needs to be cleaned up. In addition, the dumpster must be on a concrete pad and enclosed with a chain link fence, as per the Planning Board letter dated May 3, 2022, and the dumpster needs to be monitored on a regular basis with regularly scheduled pickups.

The meeting was opened to the public; the following resident spoke in favor of the proposed restaurant:

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to reserve decision.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the public hearing adjourned at 7:24 PM.
