A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, November 5, 2024. Present were Mayor Adams, Trustee Seibert, Trustee Cardali, and Trustee Bencivenga. Absent were Trustee Miga and Village Attorney Charles J. Casolaro. On the motion of Trustee Seibert, seconded by Trustee Cardali and unanimously carried, the work session opened at 5:38 PM. On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, the work session ended at 6:49 PM.

Regular meeting of the Board of Trustees opened at 8:01 PM.

The Pledge of Allegiance was led by Trustee Seibert.

On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to approve the minutes of the October 22th, 2024 regular meeting of the Board of Trustees and dispense with the reading of the same.

Mayor Adams announced two Proclamations that were being presented tonight. Deputy Mayor Seibert presented a Proclamation to honor the Babylon Citizen’s Council of the Arts (BACCA) in Celebrating 50 years. Additionally, Trustee Cardali presented a Proclamation to Matthew Rudis for his Eagle Scout project, designing and replacing the Veterans’ monument at the Gazebo.

On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to issue a refund in the amount of $50 to James Jackson (Horace & Sylvia’s) for the return of one (1) BOT sign for partial refund for the property located at 100 Deer Park Avenue. [Section 010/ Block 03 / Lot 059]

On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED grant permission to the Chamber of Commerce to maintain temporary signs from November 16th through November 30th, 2024 to advertise “Small Business Saturday.” Signs to be posted at the following locations:

  • 36” x 48” Sign – entrance to VOB - Route 109 and Montauk Highway
  • 36” x 48” Sign - entrance to VOB at end of 231 and Montauk Highway
  • 3 - 24” x 36” signs to be displayed within Babylon Village accordingly
  • 11” x 17” posters to be displayed in windows of VOB establishments.

On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to grant permission to St. Joseph RC Church to maintain the following temporary signs from November 13th through December 15th, 2024 to announce the “Messiah Concert,” benefiting the Mercy Inn Soup Kitchen, at the following locations:

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to schedule a Public Hearing to be held on Tuesday, December 10, 2024 at 7:00 PM to consider the adoption of proposed Local Law 1210PH of 2024, amending Village Code- §187- Garage Sales.

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to approve the following warrant for November 12, 2024:

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED that the Board of Trustees hereby acknowledges that pursuant to Section 2019-a of the Uniform Justice Act, the required 2023-2024 Fiscal Year (10/01/2023 to 9/30/2024) examination of the Justice Court of the Incorporated Village of Babylon was performed by the Certified Public Accounting firm of Skinnon and Faber October 21, 2024.

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to accept the resignation of Josue Mejia, full time laborer, effective November 8, 2024.

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to accept the resignation of Aidan Hoyt, part time Parking Meter Officer, effective November 15, 2024.

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried,

      WHEREAS, a Public Hearing was held on Tuesday October 22, 2024,

      BE IT HEREBY RESOLVED to approve the application of the restaurant Horace & Sylvia’s Publick House, 100 Deer Park Avenue, for a change of ownership from James Jackson and Nunzio DiLorenzo of 100 DPA LLC to Chris Cappiello and James Economou of Babylon Hospitality LLC.

      And, be it further

      RESOLVED to approve and adopt the attached covenants and restrictions for 100 DPA LLC & Babylon Hospitality LLC, 100 Deer Park Avenue. [Section 010/ Block 03/ Lot 059]


      The following announcements were made:

      • Trustee Seibert reminded all that Conklin House has Santa Paws pictures this Saturday, November 16th. Pictures for Families event is sold out. On December 6th they are having an Open House event.
      • Trustee Bencivenga stated the golf course will be closed November 12th & 13th to aerate the course. Will reopen Thursday, November 14th and will remain open as long as weather permits. Boating season is extended until December 8th for the holiday boat parade. Boats must be out of the water or winter moored by that date.
      • Trustee Cardali thanked the Village Pharmacy for the successful “Shed the Meds” event this past Saturday.

      The meeting was opened to the public and the following persons addressed the Board.
