A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, OCTOBER 10, 2023. Present were: Mayor Adams, Trustee Seibert, Trustee Bencivenga, Trustee Cardali and Trustee Miga. On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, the work session opened at 7:13 PM. On the motion of Trustee Bencivenga, seconded by Trustee Cardali, and unanimously carried, the work session ended at 7:59 PM.

Regular meeting of the Board of Trustees opened at 8:04 PM.

The Pledge of Allegiance was led by Trustee Cardali.

Fire Department Ceremony Awards honoring 50 years of service for Andris Garsils and Richard Steinhauer. The Board presented each with a proclamation.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

RESOLVED to approve the minutes of the September 26, 2023 regular meeting of the Board of Trustees and dispense with the reading of the same.

    On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

    RESOLVED to grant permission to Race Awesome to display two street banners (3’ x 20’) from October 3rd to October 22nd, 2023 to promote the Annual Catholic Health Suffolk County Marathon. The Village will assist in hanging the banners.

    On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

    RESOLVED to hire Bryan Ponce as a part time laborer at the rate of $10.50 per hour effective July 3, 2023.

    On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

    RESOLVED to grant permission to Dominick Pepito, of Universal Paranormal, to do additional Historical Walking Tours on the following dates:

                      Wednesday, November 1st, 7:00 PM – 8:00 PM

                       Sundays - November 5th, 12th, 19th, 26th, 2:00 PM – 3:00 PM

                                         December 3rd, 10th, 17th, 24th, 31st – 2:00 PM – 3:00 PM

    On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

    RESOLVED to grant permission to the Babylon Beautification Society to sell mulled (spiced) wine and hot spiced cider during their annual Christmas Market to be held on December 9th, 2023 (rain date December 10th, 2023). This permission is granted only for the 2023 Christmas Market and is contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured and a signed & notarized hold harmless agreement.

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to issue a refund in the amount of $192.00 to Tim Golub for boat slip #3051 at Boynes Canal; resident sold boat and is not using slip for final 2 months of 2023 season.

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to hire Aidan Hoyt as a part time parking meter officer at a rate of $15 per hour effective July 25, 2023.

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to accept the resignation of highway laborer Donald Bonaventure effective September 22, 2023.

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to grant permission to the Babylon Teachers Association to hold an informal golf outing at the Sumpwams Creek Golf Course on October 18, 2023, with a small group in attendance. This permission is granted contingent upon timely receipt of a notarized hold harmless agreement.

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED that pursuant to New York State General Municipal Law section 104(b), that Dawn Dahill, Deputy Village Clerk, be added to the list of people who are responsible for purchasing.

    On the motion of Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to increase Winter Mooring fees as follows: $350 for residents and $700 for non-residents.

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to grant permission to James Logan to hold an informal golf outing at the Sumpwams Creek Golf Course on October 22nd, 2023 with a small group in attendance. This permission is granted contingent upon timely receipt of a notarized hold harmless agreement.

    On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to grant permission to Christ Episcopal Church to maintain temporary signs at various merchants in the Village from October 2nd through November 14th, 2023, to advertise their Basket Bash 2023.

    On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to hire Bryan Ponce as a full-time laborer with an annual salary of $29,120 effective September 18, 2023.


    On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to increase the annual salary of Sean O’ Connor by $1,000 effective October 10, 2023 having completed his six-month probationary period.

    On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to grant permission to the Friends of the Babylon Public Library to maintain temporary signs (18” x 24”) from October 29th to November 4th, 2023 to advertise the “Friends Book Sale @ Babylon Public Library”. Signs are to be placed at the following locations:

    • Montauk Highway and Route 231
    • Entrance to Argyle Lake
    • Route 109 & Park Ave.
    • Deer Park Ave. and Park Ave.
    • Carll Ave. by Fire Department
    • Park Avenue and North Carll Ave.

    On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to hire Jack Phelan as a part time park attendant 1 at a rate of $12.00 per hour effective September 4, 2023.

    On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED that pursuant to New York State General Municipal Law section 104(b), the following people are responsible for PURCHASING:

      RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law PH0926 of the year 2023, Chapter §302-8, Penalties for Offenses, and therefore,

      BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment.

      WHEREAS a Public Hearing was held on Tuesday, September 26, 2023,

      BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law PH0926 of the year 2023, Chapter §302-8,Penalties for Offenses, is HEREBY ADOPTED as:

          On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

          RESOLVED to accept the resignation of highway laborer Henry Naulaguari effective September 15, 2023.

          On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

          RESOLVED to accept the resignation of Parking Meter Officer Stephanie Lino effective October 1, 2023

          On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

          RESOLVED to re-appoint Lynn Dunlop to the Architectural Review Board for a three-year term which will expire in October of 2026.

          On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

          RESOLVED to approve the following warrant for October 10, 2023:

              RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law 1010PH 93-8 of the year 2023 amending Village Code Chapter §93-8, Bicycles, and therefore,

              BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment.

              WHEREAS a Public Hearing was held on Tuesday, October 10, 2023,

              BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law PH1010 of the year 2023, amending Village Code Chapter §93-8, Bicycles is HEREBY ADOPTED as:
