A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, OCTOBER 25, 2022. On the motion of Trustee Bencivenga, seconded by Trustee Miga and unanimously carried, the meeting opened at 7:00 PM. On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, the board entered into executive session at 7:11 PM to discuss current ligation and human resource issues, at which time the work session was ended. On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, the executive session ended at 7:59 PM.

Regular meeting of the Board of Trustees opened at 8:05 PM.
The Pledge of Allegiance was led by Trustee Bencivenga.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to hire Maldane Cockett as a full-time laborer with an annual salary of $36,400 effective September 26, 2022.
On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was
RESOLVED to hire Jessica Litrenta as Deputy Clerk with an annual salary of $40,000 effective October 11, 2022.
On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to hire Hashem Poindexter as a part time laborer at a rate of $10.50 per hour effective September 25, 2022.
On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to move Robert Santos from part time Parking Meter Officer to full time with an annual salary of $33,800 effective October 18, 2022
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to increase the salary of George Burke to $21.00 per hour effective October 12, 2022.
On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was
RESOLVED to grant permission to the American Legion, Babylon Post 94 to hold the annual Veterans’ Day parade on Friday, November 11. The parade will begin at 10:00 AM at Foster Blvd and Deer Park Ave to Grove Place and end at Babylon Post 94, where the ceremony will be held at 11:00 AM. This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured and a notarized hold harmless agreement.
On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to grant permission to Dominic Pepito of Universal Paranormal to display a temporary sign from October 1, 2022 to October 31, 2022.
On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to grant permission to Dominic Pepito, of Universal Paranormal to do Historical Walking Tours by the locations on the attached list on Tuesdays & Thursdays from 7:00PM- 8:30PM on the following dates.
November 1st, 9th, 15th, 17th, 22nd and 29th.
December 6th, 8th, 13th, 15th, 20th, 22nd, 27th and 29th
On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to grant permission to James Giorgio of The Village Vanity and Lookable Eyewear to display temporary a 14’’ x 72’’ (6 ft) sign from October 17, 2022- completion of renovation (45-60 days).
On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to issue a refund in the amount of $18.89 to CoreLogic for overpayment of 2022-20203 taxes on the property located at 11 Bradish Lane. (008-01-150)
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to issue refunds in the amounts indicated to the applicants listed below for the return of ZBA signs. [Hearing date 9/21/22]

RESOLVED to re-appoint Mary Adams to the Tree Committee for a three-year term which will expire November 2025.
On the motion of Trustee Cardali, seconded by Trustee Bencivenga, and unanimously carried, it was
RESOLVED to re-appoint Chris Genzmann to the Tree Committee for a three-year term which will expire November 2025.
On the motion of Trustee Miga, seconded by Trustee Seibert, and unanimously carried, it was
RESOLVED to re-appoint Frank Petruzzo to the Tree Committee for a three-year term which will expire November 2025.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried,
WHEREAS, the Governor’s Office of Storm Recovery (“GOSR”) and the Town of Babylon (“Town”) awarded Bid No. 20G29, Babylon Village Coastal Outfalls, to D.F. Stone Contracting, Ltd., and
WHEREAS, all work performed by D.F. Stone Contracting, Ltd. Pursuant to Bid No. 20G29 has been completed and deemed acceptable by GOSR, the Town of Babylon and Nelson + Pope,
NOW, THEREFORE, be it
RESOLVED that all work performed by D.F. Stone Contracting, Ltd. be and is hereby accepted by the Village Board of Babylon as satisfactorily complete.

On the motion of Trustee Cardali, seconded by Trustee Bencivenga, and unanimously carried, it was
RESOLVED to accept the lease/purchase agreement #16444, between Lease Servicing Center, Inc. dba NCL Government Capital (Lessor) and Village of Babylon (Lessee) and Schedule #001 and authorize the mayor to execute the same as follows:
BE IT RESOLVED by the Board of Trustees of the Village of Babylon as follows:
1. Determination of Need. The Board of Trustees has determined that a true and very real need exists for the acquisition of the Equipment described on Schedule #001 to the Tax-Exempt Master Lease/Purchase Agreement #16444, between Village of Babylon (Lessee) and Lease Servicing Center, Inc. dba NCL Government Capital (Lessor).
2. Approval and Authorization. The Board of Trustees determined that the Agreement and Schedule, substantially in the form presented to this meeting, are in the best interests of the Lessee for the acquisition of such Equipment, and the Board of Trustees hereby approves the entering into the Agreement and Schedule by the Lessee and hereby designates and authorizes the Mayor to execute and deliver the Agreement and Schedule on Lessee’s behalf with such changes thereto as such person(s) deem(s) appropriate, and any related documents, including any Vendor Payable Account, necessary to the consummation of the transaction contemplated by the Agreement and Schedule. The Village of Babylon is authorized to enter into the lease financing with Lease Servicing Center, Inc,. dba NCL Government Capital, to finance their (2) 2024 International HV607 Garbage Trucks from Syosset Truck Sales Inc. in the amount of $476,298.00 with 7 annual payments of $84,414.08.
On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was
RESOLVED to schedule a public hearing to be held on Tuesday, November 8, 2022 at 7:00 PM to consider the adoption of proposed Local Law 1108PH 343-67 2022 to amend Village Code Chapter 343-67 Stop Intersections. Complete text of the above proposed local law will be available beginning October 27, 2022 in the Office of the Village Clerk and on the Village website, www.villageofbabylonny.gov.
On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was
RESOLVED to schedule a public hearing to be held on Tuesday, November 8, 2022 at 7:00 PM to consider the adoption of proposed Local Law 1108PH 365-20 2022 to amend Village Code Chapter 365-20 Land use regulations for the Downtown Business District. Complete text of the above proposed local law will be available beginning October 27, 2022 in the Office of the Village Clerk and on the Village website, www.villageofbabylonny.gov.
On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was
RESOLVED that the Village of Babylon will hold a General Election on Tuesday March 21, 2023 for Mayor and two Trustees, each for a term of four years.
On the motion of Trustee Seibert, seconded by Trustee Miga, and unanimously carried, it was
RESOLVED to approve the following warrant for October 25, 2022:
