The meeting opened at 7:00 pm.
Trustee Cardali led the Pledge of Allegiance.
The Village Clerk read the legal notice:
PLEASE TAKE NOTICE that a Public Hearing will be held at the Municipal Building, 153 West Main Street, Babylon, NY, on Tuesday, February 13, 2024, at 7:00 p.m., or as soon thereafter as can be heard to consider the adoption of proposed Local Law 0213PH-Tax Cap of 2024, authorizing a property tax levy increase more than the limit established in General Municipal Law §3-c.
Complete text of the above Local Law is available in the Office of the Village Clerk, on the Village website: www.villageofbabylonny.gov, or can be requested by calling the Village Clerk’s Office at (631) 669-1500.
All interested persons should appear at the above time and place, and they will be given an opportunity to be heard.

Mayor Adams stated it is not an increase in taxes, just on the levy.
Trustee Siebert stated we should have the ability to override the cap, if necessary, with discussion.
Trustee Miga agrees, we should have the ability if necessary.
Trustee Cardali agrees with Board, with the concern of inflation and we will have the ability to override.
Trustee Bencivenga stated it is a necessary tool for the Board, if needed.
Mayor Adams explained that it usually goes according to the levies of the lesser value, tax cap or the rate of inflation.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to reserve decision.
The meeting was opened to the public; no one addressed the Board.

NOTICE IS HEREBY GIVEN that the Board of Trustees of the Village of Babylon will hold a Public Hearing at 153 West Main Street, on Tuesday, February 13th, 2024 at 7:00 p.m. or as soon thereafter as can be heard, to consider the application of Massimiliano Gargiulo, of Molto Pizza, to upgrade his liquor license from beer/wine to a full liquor license and extend hours of operation at his pizzeria at 376 Deer Park Avenue.
Copy of application and plans may be examined at the office of the Village Clerk, between the hours of 9:00am and 5:00pm, Monday through Friday.
All interested persons should appear at the above time and place and they will be given the opportunity to be heard. All applicants and their duly appointed representatives must appear in person at the above hearing.

Massimiliano Gargiulo, 45 Deer Park Avenue
Mr. Gargiulo would like to install a bar and upgrade his existing liquor license from beer and wine to include liquor. He also stated that he would like to extend his hours of operation from 11:00 PM- 12:00 AM.
Trustee Seibert asked if he had a liquor license and if there would be 8 barstools and if the menu will change. Mr. Gargiulo stated that his existing liquor license is just for wine and beer, but will be extended to full liquor and the barstools will be bar height. He is also adding some new items to the menu.
Trustee Miga asked if the bar was just for drinks, or would food would be served as well. Mr. Garguilo stated there will be food served at bar.
Trustee Bencivenga commented that midnight on a Sunday is kind of late. Mr. Garguilo stated it is comparable to the area.
Trustee Cardali noticed not too much of a change, and asked about parking. Mr. Garguilo stated that there is plenty of parking in the back. Half of the lot is paved with about 9-10 spaces and ½ unpaved with gravel. Landlord is looking to pave whole back lot soon, which is a total of about 26 spots.
Mayor Adams asked about handicap parking, Mr. Garguilo responded that there is one spot in the back. Mayor Adams also noted that there is a deck on the survey and asked if it is there. Mr. Garguilo answered there is not a deck and the survey is old.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to reserve decision.
The meeting was opened to the public; no one addressed the Board.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, the meeting adjourned at 7:10 PM.
