The Pledge of Allegiance was led by Deputy Mayor Frank Seibert.


The Village Clerk read the legal notice:

NOTICE IS HEREBY GIVEN that the Board of Trustees of the Village of Babylon will hold a Public Hearing on Tuesday, February 23, 2021, at 7:00 p.m. by video conference to consider the adoption of proposed

Local Law #2 of the year 2021

to extend the moratorium on 24-hour uses in the Business District.

Attorney Glass explained that this proposed Local Law is to extend the moratorium on 24-hour uses in the business district for a period of 1 year. The intent of the moratorium is to preserve the peace and repose of the surrounding residential areas.

This moratorium was originally established by Local Law 2 of 2020 and is set to expire March of 2021. Local Law 2 of 2021 would extend this moratorium until March of 2022.

The Board all agreed that this was necessary to preserve the character of the neighborhoods, business district, and the mixed-use housing in the downtown area.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to reserve decision.

authorizing a property tax levy increase in excess of the limit established in General Municipal Law §3-c.

Attorney Glass explained that this proposed Local Law gives the Board the authority to override the tax cap at its discretion.  It doesn’t mean that they are intending to pierce the tax cap; it is simply an enabling piece of legislation.


The Board reiterated that although there is no intention of piercing the tax cap, this is a formality that needs to be done each year to avoid the potential financial impact if the tax cap is exceeded, even if it’s due to an unintentional error in calculation.The Board initially stated that this would be adopted, but due to the fact that the meeting was held via Zoom, residents have 14 days to comment by mail or email, as indicated above.


On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was


RESOLVED to reserve decision.
