The meeting opened at 7:06 pm.
Trustee Bencivenga led the Pledge of Allegiance.
The Village Clerk read the Legal Notice:
PLEASE TAKE NOTICE that the Board of Trustees of the Village of Babylon will hold a Public Hearing at the Municipal Building, 153 West Main Street, Babylon, NY, on Tuesday, May 28, 2024, at 7:00 p.m., or as soon thereafter as can be heard to consider the adoption of the following proposed Local Laws of 2024 to amend the Village Codes to include the following:
- Proposed Local Law 0528PH-§302-3, to amend the Village Code Chapter §302-3, Article I, Garbage Disposal, and
- Proposed Local Law 0528PH-§343-67 to amend Village Code Chapter §343-67, IX, to add stop signs at the following intersections:
- North East corner of Locust Avenue and Ralph Avenue
- South West corner of Locust Avenue and Ralph Avenue
Complete text of the above Local Laws will be available in the Office of the Village Clerk and on the Village website, www.villageofbabylonny.gov, or can be requested by calling the Village Clerk’s Office at (631) 669-1500.
All interested persons should appear at the above time and place, and they will be given an opportunity to be heard.

Village Code Chapter §302-3, Article I, Garbage Disposal
Mayor Adams opened by stating the reason for this amendment was to change the time when garbage should to be placed at curb, no later than 7:00AM. Previously it was stated 8:00 AM. The mayor then polled the Board:
Trustee Seibert stated that this is important, especially with the new sanitation schedule change, and is favor.
Trustee Bencivenga is in favor.
Trustee Cardali is in favor.
Trustee Miga agrees.
The meeting was opened to the public and the following person addressed the Board;
-Michael Golub, 1 Steward Ave.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED
to reserve decision.
Village Code Chapter §343-67, IX, to add stop signs
Mayor Adams polled the Board
Trustee Seibert stated it seems excessive, but hopes it slows traffic down; is in favor.
Trustee Miga feels it is necessary, if people would obey the stop signs; is in favor
Trustee Bencivenga is fine with the stop signs; in favor.
Trustee Cardali wishes there was more enforcement in areas as opposed to stop signs; not in favor of Locust Avenue and N. Railroad Avenue area; for commuters it is not very effective.
The meeting was opened to the public and the following person addressed the Board;
-Mike Golub, 1 Steward Ave.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to reserve decision.
The Village Clerk read the Legal Notice:
PLEASE TAKE NOTICE that the Board of Trustees of the Village of Babylon will hold a Public Hearing at the Municipal Building, 153 West Main Street, Babylon, NY, on Tuesday, May 28, 2024, at 7:00 p.m., or as soon thereafter as can be heard, to authorize the Village Building Inspector to condemn and then demolish the real property known as 25 E. Shore Drive, Babylon, New York 11702.
All interested persons should appear at the above time and place, and they will be given an opportunity to be heard.

Mayor Adams opened by stating this has been an ongoing situation. The homeowners were going for a mitigation grant with the State of New York to raise the property in 2014-2015. Since then, there have been a series of stalls and it is now a safety issue. In the past two weeks, the mayor received reports from our building inspector and a private engineering firm that has deemed the property unsafe and needs to come down. The Village has also been in contact with the homeowner about the finger pier; it is in the water, on its side. Nothing has been done to remedy the situation with the bulkheads. Our engineering firm also reported infestation under the house. Both reports are clear that the building is unsafe and needs to come down. The mayor then polled the Board.
Trustee Seibert – it has been a problem for quite some time, a lot of things need to be done.
Trustee Miga agrees, for safety concerns, it should come.
Trustee Bencivenga is in favor, time to go.
Trustee Cardali stated it is obviously a very drastic measure and no cooperation from the property owners. Note - no one is living there and it is not a primary residence.
The meeting was opened to the public; the following person addressed the Board:
-Edward Kent, 2 Lee Ave.
The Village Attorney stated, for the record, that this is well within the powers of the Board of Trustees and the power of the Building Inspector, noting the building inspector’s letter dated April 30th, stating that he feels very strongly and very robustly that the building is very unsafe and structurally unsound, that the building needs to be raised, and needs to come down. In the Municipal Home Rule Law, there is a section called Property, Affairs & Government, that states that it well within the power Board of Trustees to protect the preservation of life and preservation of property.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED
to reserve decision.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, the meeting adjourned at 7:25 PM.
