The Village Clerk read the legal notice:
NOTICE IS HEREBY GIVEN that the Board of Trustees of the Village of Babylon will hold a Public Hearing at 153 West Main Street, on Tuesday, September 12th, 2023, at 7:00 p.m. or as soon thereafter as can be heard, to consider the application of Roman Development LLC to open a retail fish and seafood market with a restaurant component at 32-36 Deer Park Avenue, the former location of Beehave and Guru’s.
Copy of application and plans may be examined at the office of the Village Clerk, between the hours of 10am and 4pm Monday through Friday.
All interested persons should appear at the above time and place and they will be given the opportunity to be heard. All applicants and their duly appointed representatives must appear in person at the above hearing.

Mr. Nicolia and Mr. Gambino returned to amend their application from a previous Public Hearing held on February 28, 2023 and submit updated floor plans and color renderings. The new renderings showed the interior being compliant to zoning and fire safety concerns. There were concerns from the Board of Trustees (BOT) regarding emergency exit access on second floor. Mr. Nicolia had too many tables, which limited exit paths. This was resolved by eliminating tables as seen in the drawings. Mr. Nicolia also stated that fire suppression needs to be addressed with the Water Authority & Fire Marshall, but there will be fire suppression in the building. It was also confirmed that garbage would be picked up daily. Mr. Nicola has acknowledged he is short one parking spot for the residential unit. He will go to ZBA.
The Board asked if applicant will be holding private parties. Mr. Gambino stated this was not that type of establishment. The Board also asked if elevators were up to Fire Department code. Mr. Nicolia stated that both elevators were up to code and can fit a gurney. The BOT reiterated they still have some parking concerns. Mr. Nicolia and Mr. Gambino do not foresee their business negatively impacting parking.
On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was
RESOLVED to reserve decision.
The meeting was opened to the public; no one addressed the Board.
On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, the meeting adjourned at 7:43 PM.
